When the jury ruled in Gibbs' favor on Nov. 5, awarding the 34-year-old housewife, and her husband a $1.5 million verdict against Kaiser Foundation Health Plan of Georgia, Inc., in connection with the stillborn birth of their son. The verdict followed eight days of trial and five hours of deliberation.

The Jury found Kaiser Permanente guilty of medical negligence in managing the treatment of meningococcemia which led to the amputation of both his hands and his feet because of gangrene. In it's early states, meningococcemia is certainly manageable and, when it is treated properly, gangrene can be prevented. Helen R. Reisig, through her Personal Representative John E. Reisig, Plaintiff, vs. Kaiser Foundation Hospitals and
Donald M. Kirkpatrick, M.D.

Beginning on or about September 22, 1998, Helen R. Reisig complained of abcominal burning and gas;at this time, she weighed 150 pounds. She sought treatment from defendants while she experienced worsening of symptoms after eating and weight loss. Defendants provided medical treatment to Helen R. Reisig over the course of the next year as she continued to report worsening symptoms and experienced a cumulative weight loss of 38 pounds, twenty-five percent (25%) of her body weight. Defendants failed to detect or order treatment that would detect, that Helen R. Reisig was suffering from deterioration and decay in her bowel function caused by a loss of circulation to an artery in her abdomen called the superior mesenteric artery. Complications from the continuing untreated loss of circulation in her abdomen professively worsened and she became gravely ill. Her condition was never discovered or treated in a timely manner, resulting in her death on June 30, 1999.

HMO LAWSUITS RAISE ISSUES: Kaiser Foundation Health Plan of North Carolina, the first large, out-of-state HMO to tap the N.C. market in 1985, has grappled with a spate of patient lawsuits in recent years. Since 1992, 10 Kaiser-related lawsuits have been filed in North Carolina alleging medical neglect or malpractice. Kaiser, with 127,000 members, is the fifth-largest HMO in the state. In that period, the company has drawn more lawsuits from patients than other HMOs, according to an examination of state records and court records (CHARLOTTE OBSERVER, 5/12)
